By accessing our website, creating an account, or purchasing from GINA&AURA, you agree to these Terms, subject to rights that cannot legally be excluded under applicable law.

GINA&AURA is an Ontario, Canada-based lifestyle and spiritual wellness brand offering products that may include:

Our collections are thoughtfully selected around our belief in bringing nature, intention, and meaningful energy into everyday spaces.

PRODUCTS & AVAILABILITY

All products are subject to availability.

We may change or discontinue products, quantities, descriptions, pricing, promotions, and availability, subject to applicable law.

Adding an item to your shopping cart does not reserve or guarantee that item.

Many GINA&AURA products are living, natural, handmade, individually sourced, or one of a kind. Reasonable variations should therefore be expected.

LIVING PLANTS

Every plant is a living organism and naturally unique.

Plants may vary from photographs in characteristics including size, height, leaf count, leaf shape, colour, variegation, growth pattern, natural markings, and maturity.

Unless expressly stated otherwise, product photographs are representative and may not depict the exact individual plant you receive.

Natural variations, minor cosmetic imperfections, and normal characteristics of living plants are not necessarily defects.

OUR PLANT ACCLIMATION PROCESS

At GINA&AURA, we believe plants should be prepared for their next home—not simply sold fresh from the greenhouse.

Plants offered by GINA&AURA may undergo our signature acclimation and care process, which can include gently removing the original growing medium, inspecting and cleaning the roots, repotting the plant in a handcrafted soil blend curated for its variety, cleaning and treating the foliage with our organic plant spray, acclimating the plant to an indoor environment, and monitoring its health and growth.

We offer plants once we believe they are healthy and established.

Once a plant leaves our care, however, environmental and care conditions are outside our control.

PLANT CARE

Continued plant health may depend on factors including watering, light, temperature, humidity, airflow, soil conditions, pests, placement, handling, seasonal conditions, and household environment.

Plant-care information provided by GINA&AURA is general guidance.

Except where applicable law provides otherwise or we expressly provide a separate written guarantee, GINA&AURA cannot guarantee the continued survival, growth rate, appearance, or condition of a living plant after it enters the customer's care.

CRYSTALS & NATURAL MATERIALS

Crystals, minerals, stones, and other natural materials vary naturally in colour, pattern, shape, size, weight, clarity, texture, mineral inclusions, natural fractures, and surface markings.

These characteristics form part of the individuality of natural materials and generally are not defects.

Unless a listing expressly states that you will receive the exact item pictured, photographs may represent the product type rather than the specific piece you receive.

SPIRITUAL & METAPHYSICAL INFORMATION

GINA&AURA celebrates the cultural, traditional, spiritual, and metaphysical associations connected with crystals, plants, mindfulness, ritual, intention, and energy.

References to crystal energy, chakras, zodiac associations, elements, manifestation, grounding, cleansing, protection, Reiki, intuition, emotional balance, spiritual wellness, or similar concepts are provided for spiritual, informational, educational, and entertainment purposes.

Such information is not intended to diagnose, treat, cure, or prevent disease or a medical or mental-health condition and does not replace professional healthcare or other qualified professional advice.

Individual spiritual experiences vary. GINA&AURA does not guarantee a particular physical, emotional, spiritual, financial, or other outcome from using our products.

PRODUCT PHOTOGRAPHY & COLOUR

We make reasonable efforts to present products accurately.

Actual colour and appearance may vary because of lighting, photography, device displays, screen settings, natural materials, and the individual characteristics of living or natural products.

PRICING & TAXES

Prices are displayed in the currency indicated on our website.

Applicable taxes, shipping fees, and other applicable charges will be presented during checkout.

We may correct genuine pricing, typographical, or product-information errors subject to applicable law.

ORDERS

Submitting an order does not necessarily constitute final acceptance by GINA&AURA.

We may decline or cancel an order where reasonably necessary, including because of product unavailability, inventory errors, pricing or listing errors, payment problems, suspected fraud, shipping limitations, duplicate or unusually large orders, or other circumstances preventing fulfillment.

If we cancel an order after collecting payment, an appropriate refund will be issued for the cancelled portion.

Nothing in this section limits rights available under applicable law.

PAYMENT

Payment is due at checkout unless otherwise stated.

We accept payment methods made available through our Squarespace checkout.

Available methods may change depending on the payment services supported by Squarespace and connected to our store.

By submitting payment information, you represent that you are authorized to use the selected payment method.

SHIPPING

GINA&AURA currently ships eligible products within Canada only.

Living plants are not currently available for shipping.

We currently offer a $9.95 flat shipping rate on eligible Canadian orders and free shipping on qualifying orders over $75 CAD before applicable taxes, subject to the terms of our Shipping Policy.

LOCAL DELIVERY

Local delivery is available for eligible orders, including living plants, to selected postal codes within the Greater Toronto Area.

Delivery fees are charged per order in Canadian dollars, with applicable taxes displayed at checkout:

• $9.95 | Maple, Vaughan, Woodbridge, Concord, Thornhill and Richmond Hill.

• $14.95 | Toronto, Aurora, Newmarket, Markham, Mississauga and Brampton.

• $19.95 | Oakville, Burlington, Milton, Georgetown, Stouffville, Pickering, Ajax, Whitby, Brooklin, Oshawa, Courtice and Bowmanville.

Toronto delivery includes eligible addresses in North York, Scarborough, Etobicoke, East York and York.

Availability is determined by your delivery postal code. Some rural or outlying addresses within the listed communities may fall outside our delivery area. Local delivery and the applicable fee will appear at checkout for eligible addresses.

DELIVERY SCHEDULE

Our free shipping offer on qualifying orders over $75 does not apply to local delivery.

Local deliveries take place on Saturdays between 10:00 a.m. and 4:00 p.m. Eastern Time.

Orders placed by Wednesday at 8:00 p.m. Eastern Time are eligible for delivery that Saturday, subject to product readiness and delivery availability. Orders placed after the cutoff are scheduled for the following Saturday. If we cannot meet that schedule, we will contact you to arrange an alternative.

We will contact you before delivery to confirm your scheduled date and provide an estimated arrival window. Exact arrival times cannot be guaranteed.

RECEIVING A LOCAL DELIVERY

Please provide a complete and accurate delivery address, including any unit number, buzzer code, contact number and building-access instructions.

For orders containing living plants, please arrange for someone to receive your delivery and bring the plants indoors promptly. Unattended delivery may not be suitable for certain products or weather conditions.

Weather, traffic or other unexpected circumstances may affect delivery arrangements. If your delivery needs to be rescheduled, we will contact you.

If we cannot complete a delivery because of an incorrect address, an access issue or an unavailable recipient when a handoff is required, we will contact you to arrange the next step. Any additional redelivery fee will be explained and agreed with you before another delivery is arranged.

To request a change to your delivery address or instructions, contact info@ginaandaura.com as soon as possible and include your order number. Changes may affect delivery eligibility, fees or timing.

LOCAL PICKUP

Local pickup is available for eligible orders in Maple, Ontario, Canada.

Orders may be available for pickup as early as the next day, subject to preparation, product availability, and confirmation from GINA&AURA.

Please do not arrive for pickup until you have received confirmation that your order is ready.

ALL SALES ARE FINAL

All GINA&AURA sales are final.

We do not offer voluntary returns or exchanges for change of mind, personal preference, natural product variation, or ordering the incorrect product or size.

This policy applies to living plants, crystals, minerals, spiritual goods, home décor, gifts, accessories, sale merchandise, and other products unless otherwise expressly stated.

This policy does not limit rights or remedies that cannot legally be excluded under applicable consumer-protection law.

DAMAGED, DEFECTIVE OR INCORRECT ORDERS

If an item arrives damaged in transit, is materially defective, or you receive an incorrect item, please contact us as soon as reasonably possible at info@ginaandaura.com.

We may request photographs, your order number, packaging photographs, and other reasonable information necessary to assess the issue.

Depending on the circumstances, product availability, and applicable law, an appropriate resolution may include replacement, store credit, refund, or another reasonable remedy.

PROMOTIONS & DISCOUNT CODES

Promotions and discount codes may be subject to additional conditions including expiration dates, minimum purchases, product exclusions, usage limits, and restrictions on combining offers.

Unless otherwise stated, promotions cannot be applied retroactively to completed orders.

CUSTOMER ACCOUNTS

If you create a customer account, you are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Please notify us if you believe your account has been accessed without authorization.

ACCEPTABLE WEBSITE USE

You agree not to use our website:

• For unlawful purposes

• To commit fraud

• To interfere with website operation or security

• To introduce malicious software or code

Unless otherwise stated, GINA&AURA website and brand content is owned by, licensed to, or used with permission by GINA&AURA Inc.

This may include the GINA&AURA name and branding, logos, photography, videos, product descriptions, website copy, graphics, artwork, designs, social-media content, plant-care materials, crystal descriptions, and original written or educational content.

You may not reproduce, modify, distribute, republish, sell, or commercially exploit protected GINA&AURA content without authorization except as permitted by law.

THIRD-PARTY SERVICES

Our website may integrate with third-party services including Squarespace, payment providers, Google, Meta, shipping providers, and other technology services.

Third-party services may be governed by their own terms and privacy policies.

GINA&AURA is not responsible for the independent practices or content of third-party services.

DISCLAIMER OF WARRANTIES

To the extent permitted by applicable law, our website and its content are provided on an “as available” basis.

Natural and living products inherently vary.

Nothing in these Terms excludes any warranty, condition, right, representation, or remedy that cannot legally be excluded under applicable law.

LIMITATION OF LIABILITY

To the extent permitted by applicable law, GINA&AURA Inc. will not be liable for indirect, incidental, special, or consequential losses arising from use of our website or products where such liability may lawfully be limited or excluded.

Nothing in these Terms is intended to restrict rights or remedies that cannot legally be waived.

Use of our website is also subject to our Privacy Policy, which describes how we collect, use, disclose, and otherwise handle personal information.

CHANGES TO THESE TERMS

GOVERNING LAW

These Terms are governed by the laws applicable in the Province of Ontario and the federal laws of Canada applicable therein, subject to mandatory consumer-protection rights and other laws that cannot legally be excluded.
